Painting Contract Terms & Conditions

These are the Terms and Conditions of Contract that apply to every quotation issued by Performance Painting Contractors CC. They are signed by the Customer before work begins and form part of the contract.

Terms & Conditions of Contract

  1. All transactions shall be subject to the Terms and Conditions, signed prior to commencement of the project. The Contractor being Performance Painting Contractors CC.
  2. This quotation is valid for a period of 21 days. If the quotation is accepted within the 21 day period, commencement must be within 30 days of the signed T’s & C’s.
  3. Should the price of paint or fuel increase during the contract, the existing price may alter accordingly.
  4. Colours must be chosen by the Customer before the commencement date. All quotes are priced on whites and pastel colours. Should colours be deep or transparent bases, the price will be altered accordingly.
  5. Should the Customer request more than two colours or paint types, the Customer will be charged an extra fee.
  6. The Customer shall be entitled to 3 FREE Plascon or Dulux samples per project.
  7. Should a Customer require the Contractor to temporarily leave a project due to building or any other reason, a re-establishment fee of R3 000.00 (excluding VAT) will be charged over and above the accepted quotation price.
  8. The Customer shall provide access to water, toilet facilities, electricity and lock-up facility (storeroom) for the Contractor and his staff.
  9. The Customer shall agree to supply all security needed for scaffolding erected to the exterior of the premises. We will not be held responsible or liable for any security issues.
  10. The Contractor will be permitted to erect signage on the property whilst we are active on site.
  11. The Contractor shall not be responsible for any damages arising from instructions issued to the Contractor’s employees without the Contractor’s written authority. The Contractor shall not accept responsibility for any general structural or other damage, which may occur, due to reasons beyond the Contractor’s control.
  12. The Customer is requested to trim all hedges and trees obstructing the area to be painted before the commencement of the project.
  13. When pressure cleaning roofs, we will not be held responsible for leaking roofs and damages that may occur due to reasons beyond our control.
  14. The quote excludes any fees payable for working on private properties or estates.
  15. The Contractor has not allowed for the removal or replacement of any sign writing or sign boards unless specifically mentioned, in writing, in the quotation.
  16. The Contractor does not accept responsibility for any conspicuous exaggerations of imperfections in skimming and re-plastering due to the light reflecting at an angle to the surface.
  17. No liability shall be accepted by the Contractor for any loss or damage to any property or injury or death of any person or any loss to any person caused by, or arising out of the use of or interference with plant, machinery or means of access by persons other than the employees of the Contractor, and the Customer hereby indemnifies the Contractor against third parties in respect of any such loss, damage, injury or death. The Contractor is fully covered by Public Liability and Contractors All Risk to the value of R5-million.
  18. The Contractor will issue the Customer with a final invoice on completion of the contract. Payment will be expected within 5 days of invoice date.
  19. If the final payment is not received by the Contractor at the time of completion and subsequent invoice, the guarantee offered in terms of the contract could become null and void.
  20. Should an arbitrator be called upon to adjudicate any issues in dispute, it is agreed that in the event of the arbitrator’s decision being in favour of the Contractor, the Customer will pay the arbitrator’s costs.
  21. If Performance Painting Contractors CC has to stop the painting contract due to a Force Majeure circumstance, we will not be held liable for any costs.
  22. Performance Painting Contractors CC may use other Contractors at our discretion to assist us with the project, i.e. scaffolding, cleaning, structural repairs etc.

Acceptance

The quotation is signed by the Customer to constitute a contract, duly signed and accepted as per all terms and conditions. The signed document records the quote reference, the date and place of signature, the colours chosen, and is countersigned by Performance Painting Contractors CC.
